[2013] TLQ Online 9. Katja Brecke on German decisions on Regulation 261/2004

On 3 January 2013 the German Federal Court of Justice (Bundesgerichtshof/BGH, ‘the Court’) handed down its reasoning in two separate cases relating to the right to compensation for flight delays, X ZR 12/12 and X ZR 14/12, both dating from 13 November 2012. The Court held in both cases that passengers are not entitled to compensation under Regulation (EC) No 261/2004 (‘the Regulation’) if the delay occurred on a connecting flight departing from outside the territory of the European Union.
