Ethnic Profiling. Airline held to account

Braathens Regional Aviation paid compensation to a passenger who had been subjected to an additional security check on the grounds of his ethnic appearance. They did not however admit to any racial discrimination and the Swedish courts, on the basis that compensation had already been paid, declined to make a declaration as to whether discrimination had taken place.

In this case brought before the ECJ by the Swedish Equality Ombudsman, it was held that nothing in Swedish domestic law should preclude a person from seeking such a declaration.
