European Commission issues guidance on use of claims agencies in Regulation 261 cases
The European Commission has recently issued guidance on the use of claims agencies by consumers seeking compensation under Regulation 261/2004 for denied boarding, cancellations and long delays.
The gist of the guidance is to suggest that consumers first of all try contacting airlines direct or use ADR to obtain compensation. It then goes on to remind claims agencies of their legal obligations, in particular to clearly display prices on their websites, to be able to produce clear powers of attorney, not to engage in unsolicited telemarketing and not to abuse personal data.
